These terms of sale (the "Terms") govern your purchase of digital products (the "Product") from our website (the "Site"). By completing your purchase, you agree to be bound by these Terms.

1. Eligibility. You must be 18 years or older to purchase Products from the Site.

2. Order Process. All orders for Products are subject to our acceptance. We may reject any order in our sole discretion. Once we accept your order, we will provide you with a confirmation of your purchase.

3. Payment. You agree to pay the price for the Products as set forth on the Site at the time of your purchase. We accept major credit cards as set forth on the Site.

4. Delivery. After we receive your payment, we will make the Product available for download from our Site.

5. Refund Policy. We do not offer refunds for digital products. All sales are final. If the downloaded product is faulty please contact us within 28 days of purchase.

6. License. After you purchase a Product, we grant you a limited, non-exclusive, non-transferable license to use the Product in accordance with the product's terms.

7. Prohibited Uses (unless specifically permitted in your individual product licence). You agree not to: a. Resell, distribute, or otherwise make the Product available to any third party; b. Use the Product in any way that violates any applicable law; or c. Use the Product in any way that infringes the intellectual property rights of any third party.

8. Termination. We may terminate your license to use the Product at any time for any breach of terms and condtions. Upon termination, you must cease all use of the Product and destroy all copies of the Product in your possession.

9. Disclaimer of Warranties. THE PRODUCT IS PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE, OR NON-INFRINGEMENT. WE DISCLAIM ANY WARRANTIES REGARDING THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THE PRODUCT.

10. Limitation of Liability. IN NO EVENT SHALL WE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR PURCHASE OF PRODUCTS FROM THE SITE.

Licence

Subject to payment of the corresponding fee and adherence to the limits below and the other terms of this disclaimer, you may, for your own personal use:

(a)   download a copy of the notebook PDF file and supporting files from us or from one of our partner service providers;

(b)     store, view and use the digital notebook on a desktop or notebook computer[s];

(c)     store, view and use the digital notebook on a mobile device or tablet[s];

(d)     store and view the digital notebook on a cloud storage service[s], providing that the files are not made publicly accessible or shared with other users.

You may not:

(a)    publish, republish, sell, licence, sublicense, rent, transfer, broadcast, distribute, or disseminate the digital notebook in whole or in part;

(b)   Use the digital notebook files commercially in any way;

(c)     Remove or obscure the copyright notices, terms and conditions, or intellectual property notices included within the digital notebook.

Exceptions:

Where an educational group licence has been purchased, additional licence rights are given as detailed within the educational group licence statement provided.

Intellectual Property Rights

Whether altered or not, the product, including any intellectual property and copyright included within, are and will always be our sole and exclusive property. You agree that regardless of whether the product has been modified or not, you will not claim ownership of any intellectual property rights or copyright in the product.

We use the name Doodle Reads and the accompanying logo as a trademark.

Other trademarks or service marks in the digital notebook are the property of their respective owners. Unless otherwise stated, we do not endorse or have any affiliation with the holders of such rights.

Disclaimer

The information contained in the digital notebook is for general information purposes only.

While we make every effort to assure the quality and completeness of the material in the digital notebook, we cannot guarantee or represent its completeness or correctness.

We shall not be liable to you for any losses, such as lost or damaged profits, income, revenue, use, production, projected savings, projected outcomes, business, contracts, commercial potentials, or goodwill.

Even if notified of the possibility of such losses, we will not be responsible to you or anyone else for any decision made or action taken in reliance on the information provided by the digital notebook, or for any consequential, special, or similar damages.

We shall not be obligated to you in the event that any of your data, database, or software is lost or corrupted in your use of the digital notebook.

We shall not be liable for any loss or error as a result of the functionality, availability, or suitability of any third-party applications that are used by you in conjunction with the digital notebook.

As a user of this licence, it is your own responsibility to keep backup versions of the original files supplied, as well as of any notebooks that you create from them using third-party apps.

Educational multiple-copy licences are only available to teachers and other educational professionals. They are exclusively for use in a school, college, or university setting where the licence-holder currently works.

There is a discount for buying educational multiple-copy licences, but only at the time of purchase.

The licence-holder may distribute copies to pupils, students, or other teachers, within their institution up to the number purchased. Each copy distributed in this way may only be used by a single recipient, and our standard terms of use for that copy (including the right to use and store) will be permanently transferred to that recipient. Once a copy has been distributed to an individual recipient (student or teacher), it may not subsequently be re-assigned to another at a later time.

After purchase, a single copy of the electronic files is provided. The licence-holder may make copies solely for the purpose of distributing them to qualifying individuals up to the number purchased. The licence-holder may not upload the digital files to any server or service where they have no control over the number of copies that may be downloaded. The licence-holder may choose to assign a copy for their own use.

Terms and conditions that pre-exist for individual products will continue to apply to all copies distributed under this licence. Please read these terms and conditions before purchase, they can be found on this page.

The licence-holder will be asked to provide details of their job title along with details of the educational institution where they work. In the event that the information provided is not accurate, the licence will be void. If the licence-holder leaves the employment of the named educational institution, the right to distribute copies under the terms of the licence can be transferred to another employee of that school, college or university.

Educational Teacher licences are only available to teachers and other educational professionals. They are exclusively for use in a school, college, university, or in private one to one tuition. You, as the licence-holder, are granted rights to use the resource for your own personal use or to use it in the context of teaching your students. As a licence holder, you may distribute copies to your own students for the sole purposes of teaching and study. Each copy distributed in this way may only be used by your individual students for the purpose of their own study. Your students gain no rights to distribute these resources further in any way.

After purchase, a single copy of the electronic files is provided. As licence-holder, you may make printed or digital copies of the resource as long as it is solely for the purpose of personal use, or for distributing to the students that you have a direct responsibility to teach. As a licence-holder, you may not upload the digital files to any server or service where you have no control over who has permission to download, or the number of copies that may be downloaded.

As licence-holder, you will be asked to provide details of your job title along with details of the educational institution where you work. In the event that the information provided is not accurate at the time of purchase, the licence will be void. However, as the licence-holder, if you leave the employment of the named educational institution, the Teacher Licence remains with you if you subsequently move to a new school, college, or university. This licence cannot be transferred to another teacher once the resources have been used in any context.

All other terms and conditions attached to the resource still apply, except where those terms contradict permissions granted by this Educational Teacher Licence.
